Is ADHD a Learning Disability?

My daughter goes to school in Missouri.  Appaently Missouri does not consider ADHD a learning disability.  I'm worried my daughter will get discouraged if she gets to far behind.  Is there anything I can do to help.  Is Section 504 a federal law that could help?

Ron: Thanks for your e-mail. Under federal law (IDEA and Section 504 of the Rehabilitation Act), ADHD is a disability. It is not within the power of the State to contradict that. Tell them to look at 34 CFR 300.7 (c)(9)(i).You should demand a case study evaluation immediately. Do this in writing. They have 60 schools days to complete that. After the CSE is completed, they must hold an IEP meeting. That meeting will determine whether your daughter is eligible for special education or educational (IDEA) accommodations (section 504). If eligible, they will develop an educational plan or accommodations. If they refuse to do the CSE, you can file a complaint with your state board of education or the U.S. Justice Department.
