As part of our "Parent To Parent Series, one visitor wrote asking for assistance for a friend: Teenager In Need
I have a friend with a teenager who has been diagnosed
with ADHD and depression. He is on Paxil and Adderall. His mom is having
major problems with him writing down homework assignments, completing the
work, failing tests (because he didn't remember to study) and he has become
extremely defiant in school and at home. What are her rights at school for
requesting an educational evaluation and setting up an IEP. The information
on the web is confusing, and I'm trying so hard to help her.
Some of the responses and ideas that were received were; *****YOUR FRIENDS SON IS ENTITLED TO AN INDIVIDUALIZED EDUCATION PROGRAM. ALL SHE NEEDS TO DO IS GO TO THE PRINCIPAL AND REMIND THEM THAT ADD HAS BEEN CLASSIFIED BY US GOVT AS A HANDICAP THEREFORE ENTITLING HIM TO BENEFITS UNDER THE INDIVIDUALS WITH DISABILITIES EDUCATION ACT. THEN THE SCHOOL'S CHILD INTERVENTION TEAM NEEDS TO EVALUATE HIM AND PLACE HIM ACCORDINGLY. IT IS A ROUGH ROAD, BUT SHE HAS TO BE ADAMANT ABOUT DEMANDING WHAT HER CHILD IS ENTITLED TO UNDER THE LAW AND SHE AS THE CHILD'S ONLY ADVOCATE MUST DEMAND THAT SERVICES BE PROVIDED TO HER SON. THERE ARE PLENTY OF WEB SITES THAT SET FORTH WHAT HER SON IS ENTITLED TO. *****I just wanted to let you know that I am going through the same thing. My daughter is ADHD and Bi-Polar. I recently found out that by law the schools have to do at least a 504 plan. The 504 plan makes the teachers and administration work with you and the child as far as maybe special seating, extra time to work on assignments, a peer study person, sitting them by a positive role model in school. If the child is tested and found to be Emotionally Disabled, then not only does the child have the 504 (State level) to back them up but they have I.D.E.A (Federal level) to back them up. With I.D.E.A, the parent has all kinds of rights. Hope this helps. Tell the parent to contact The Center for Disability Law. They can get good advice from them as well as classes for parents to become advocates. Stacey

ALL MY SCHOOL MEETINGS SHE TOOK NOTES AND RAN THE WHOLE PROCESS THIS IS
TOTALLY FREE!, OTHER WISE I COULD NOT HAVE DONE IT MY SELF, I DON'T KNOW WHAT
AREA YOUR FRIEND IS IN BUT I HAVE BEEN THROUGH THIS WHOLE PROCESS AND,
THE FIRST THING SHE NEEDS TO DO IS TELL THE SCHOOL IN WRITING SHE WANTS AN
INDEPENDENT EDUCATIONAL EVALUATION SHE NEEDS TO DO THIS IN A LETTER ALL SHE
HAS TO WRITE THIS IN A LETTER FIND OUT WHO THE HEAD OF SPECIAL
EDUCATION IS AND TAKE THE LETTER TO THAT PERSON, AND THEY HAVE LIKE 3 DAYS OR
SOMETHING LIKE THAT TO GET BACK WITH YOU , I HAVE THE NAME OF THE ADVOCATE I
USED AND HER NUMBER IF YOU WOULD LIKE TO HAVE IT SHE'S IN THE CINCINNATI AREA
, AND THIS EVALUATION IS COMPLETELY FREE IF THE SCHOOL DOES IT , ALSO IF
YOUR NOT HAPPY WITH THEIR RESULTS, THEY HAVE TO PAY FOR A EVALUATION OUT
SIDE THE SCHOOL .....
